North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)facility - safety latch on the 480 volt, Dayton underhung electric chain hoist, was not inspected and repaired when found defective. Reference ANSI B 30.16, section 16-2.1.2, paragraph c-6. Among other methods, one feasible and acceptable method to correct this hazard is to establish a program of inspections of hoists in the facility to detect defective parts such as safety latches or other parts of the hoist system and replace broken parts as needed. b)facility - hoist mounting frame for the 480 volt, Dayton underhung electric chain hoist, was not marked with the manufacturers load rating. Reference ANSI B 30.16, section 1.2.2. Among other methods, one feasible and acceptable method to correct this hazard, is to contact manufacturer of the hoist support beams and rails fore the load rating and mark the support system with the load rating. c)facility - periodic and documented inspections of all hoist systems to include the connecting frame, trolleys, hoist with components and below the hook devices were not conducted by a designated person. Reference ANSI B 30.16 section 16-2.1, paragraph b 2. Among other methods, one feasible and acceptable method to correct this hazard is to designate a qualified person to conduct the periodic inspections and document the results of such inspections.
