North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall to a lower elevation while working from a the forks of a rough terrain forklift. (Reference paragraph 6.2.8, ASME B56.6-1992) a)North side of Sanctuary: an employee was observed standing and pulling plywood from the exterior of the building while standing on a N&N Turbo 6036 fork lift, SN # T0945G6673, approximately 4' above the ground. Among other methods, one feasible and acceptable means of abatement would be to work from a ladder while removing the plywood or to adhere to the provisions of the ASME standard B56.6-1992.
