Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls: On or about March 27, 2003, at the jobsite located at Baymont Inn, in Springdale, Arkansas, employees working from Genie S-60 aerial lifts were exposed to injuries from falls due to not being protected from falls by the use of personal fall arrest systems. One feasible method of abatement, among others is to initiate and require the use of the personal fall arrest systems mandated by the American National Standards Institute's standard for boom-supported elevated work platforms.
