Section 5(a)1 of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to struck-by hazards:
On or about January 24, 2003, employees surveying Kansas Highway 7, just
North of Girard,
Kansas were not protected from on coming motorist by warning signs being
positioned in
advance of the work area nor were bright reflective vests  used to
increase worker visibility.
Employees were exposed to struck-by hazards of vehicular traffic.
Among other methods, one feasible and acceptable method to correct this
hazard is: Position
appropriate advance warning signs as prescribed by the Manual on Uniform
Traffic Control
Devices for Streets and Highways, Part VI, Traffic Controls For Street and
Highway
Construction, Maintenance, Utility and Emergency Operations, 6A-5.

29 CFR 1903.19(d)(1) requires certification and documentation that the
abatement of the
above violation is complete.
