Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall, crushing and struck-by hazards: On or about June 18, 2003 at the East High School jobsite located at 2301 E. Douglas Ave., Wichita, KS, employees working on the Morgen Tower Scaffold at a height of approximately 25 feet to the ground below were exposed to fall, crushing, and struck-by hazards associated with a scaffold collapse. The employer did not ensure that the manufacturer's instructions were followed when assembling and using the the Morgen Tower Scaffolding: a) A piece of rebar was used to block the carriage during the process of adding a tower section. The manufacturer's instructions state to use a 2x4. b) The speed regulating safety dog was wired back while the carriage was being lowered to release tension on the cable. c) Bracing was not installed in accordance with manufacturer's instructions. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD IS: FOLLOWING THE MANUFACTURER'S INSTRUCTIONS FOR ASSEMBLY AND USE OF MORGEN TOWER SCAFFOLDING. 29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is complete.
