North Carolina General Statute 95-129(01) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)jobsite, on or about January 6, 2003 employees used the bucket of a backhoe loader as a work platform. Ref: Equipment Manufacturers Institute Safety Manual for operators and mechanics Backhoe/Loader Page 22, REMEMBER THE OTHER PERSON (continued) Never use a bucket for a work platform or personnel carrier. Warning:Never let anyone in or near the pivot area of articulated machines. Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to prohibit employees from using a bucket as a work platform.
