North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Ref: ANSI B135.1-1990, American National Standard for Automotive Lifts - Safety Requirements for the Construction, Care, and Use. Paragraph 7. Maintenance, Use, and Inspection, sub-paragraph 7.1.3 Modifications to any lift shall not be made without the prior written consent of the lift manufacturer. a)facility, a braking device on a 12,000-lb Four Post Bend Pack Automotive Lift had been tack welded in the open position without written permission from the manufacturer. Note:Among other methods, one feasible and acceptable abatement method to correct this hazard is for the employer to contact the manufacturer for the best recommended repair technique.d
