Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to having their head and torso entrapped between the truck and ground in the event of tip over: a) On or about 1/15/03, the employee operating the Komatsu fork lift truck was not required to wear the seatbelt that was provided on the truck. Among feasible methods to abate this hazard is to comply with the American National Standard Institute (ANSI) Safety Standard for Low Lift and High Lift Trucks, ANSI B56.1-1988, Section 5.3.19 and wear seatbelts at all times when operating the truck.
