Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a struck-by hazard: On or about 1/20/03 on State Highway 836, employees setting up a lane closure of the inside westbound lane of the 6 lane highway were exposed to a struck by hazard. One feasible and acceptable means of abatement is the use of a Truck Mounted Attenuator (TMA) as referenced in Part IV of the Manual on Uniform Traffic Control Devices (MUTCD), Millenium Edition, Chapter Six, Section 6F-76. PLEASE NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
