Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: On or about 6/27/03, directly outside the southern part of the facility, employees were exposed to the hazard of being thrown from a powered industrial forklift because the employer did not provide an operator restraint device. Among other methods, one feasible and acceptable abatement method is to install a seatbelt to the seat of the forklift. PLEASE NOTE: CERTIFICATION OF ABATEMENT IS NOT REQUIRED FOR THIS VIOLATION.
