Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees refueling equipment were exposed to struck-by and crushing hazards: On or about 07/14/03, employees engaged in the task of equipment refueling were exposed to the hazard of being struck-by and crushed by loads (i.e., fuel tanks) that were not secured while being transported on the forks of earth moving equipment. Among other methods of abatement, one feasible and acceptable method to correct this hazard is to secure loads being transported on the fork attachment of the earth moving equipment. PLEASE NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.

Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees refueling equipment were exposed to run over hazards: On or about 07/14/03, where the view in the direction of travel of a front-end loader was obstructed and where obstructions were encountered, no spotter had been designated by the employer to direct the traffic of the equipment being driven under these conditions. Among other methods of abatement, feasible and acceptable methods to correct this hazard are: (a) to designate a person to direct the traffic of loaded earth moving equipment; or (b) to prohibit employees to be near or around the earth moving equipment while it is moving. PLEASE NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
