Section 5(A)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or were likely
to cause death or
serious physical harm to employees in that employees cutting grass were
exposed to falling
hazards:
On or about 07/29/03, employees engaged in the task of cutting grass were
exposed to the
hazard of falling while operating a lawn mower tractor near the
unprotected edge of a culvert.
Among other methods of abatement, one feasible and acceptable method to
correct this hazard
is to keep lawn mower tractors at least six (6) feet from the edges of the
culvert and to cut this
grass by means of alternative methods such as, but not limited to, weed
eaters.
PLEASE NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS
VIOLATION.
