Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling to the ground while working in an unsecured platform raised in the air by the forks of a rough terrain powered industrial truck: (a) On or about 1/29/03, at Eckerd construction site, 8520 Transit Road, Amherst, NY: An employee was securing weatherproofing while in a "cage-type" workplatform supported in the raised position by the forks of a CAT Rough Terrain Forklift Truck. The workplatform was approx. 15 ft. above the ground and was not secured to the truck. Among others, a feasible method to eliminate or materially reduce this hazard is to: 1. Install properly sized chains to secure the workplatform to the forklift truck. NO ABATEMENT CERTIFICATION REQUIREDATION
