A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that the employer did not require operators of powered industrial trucks to utilize operator restraint devices (i.e. seat belts) while operating such trucks to restrain the operator in the event of a rollover. (a) 620 West Commerce Avenue Gilbert, AZ 85233: One (1) employee was operating a Toyota forklift, Model# 02-5FD40 and Serial# 70063, without wearing a restraining device (i.e. seat belt).
