Section 5(a)(1): Each employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to his employees. On July 1, 2004, a temporary worker at ConAgra Foods was injured when cleaning the elevator near Filler Line 3. Smith Personnel Solutions was to go over general safe practices and good manufacturing practices with temporary workers before sending them to ConAgra. Requested documentation could not be provided by Smith Personnel Solutions to substantiate that this procedure is followed. Statements from temporary workers claim that this procedure was not done before they went to ConAgra. The employer needs to ensure that the dispatchers carry out the policies and procedures that have been agreed upon between Smith Personnel Solutions and their clients. Records need to be documented and filed appropriately to show that these procedures have been accomplished.
