Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The recognized hazard of being struck by falling objects from the underside of a conveyor wherever a conveyor passes over a main aisleway, regularly occupied work area, or passageway. On or about August 18, 2004, a means was not provided to prevent objects from falling through conveyor pulleys that passed over main passageways at the Albertson's Distribution Center in Fort Worth, TX. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide nets under conveyors that pass over the main aisleway in the Distribution Center as per the requirements of ASME B20.1-1996, "Safety Standards for Conveyors and Related Equipment," Section 5.9.2(d), which states that guards "shall be provided if material may fall off the conveyor and endanger personnel."
