Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment free
from recognized
hazards that were causing, or likely to cause, death or serious physical
harm to employees in
that a worker was exposed to a fall greater than 20 feet while
standing/working from an
elevated load that was attached to the forks of an Ingersoll-Rand rough
terrain forklift.
Among other means, some feasible and acceptable abatement methods to
correct these
hazards are:
1.Only use forklifts to lift/support personnel if they are specifically
designed by
the manufacturer for such use.
2.If the manufacturer's design permits the use of their equipment to
support
personnel, follow the requirements set forth in The American Society of
Mechanical Engineers, ASME B56.6-2002 Safety Standard for Rough Terrain
Forklift Trucks, Part II, Section 5.15 entitled Elevating Personnel & Part
III,
Section 8.24 entitled Platforms for Elevating Personnel.
3.Plan, schedule, and 1ayout work activities accordingly to ensure
individuals
are not supported by and/or do not access loads that are elevated by
material
handling devices, i.e., rough terrain forklifts.
