Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazard trees being bucked and planned for no escape route for emergency egress purposes. On or about 5-13-03, employees did not plan for an emergency escape route for the job they were conducting. Among other methods, one feasible and acceptable method to correct this hazard is to have a escape route planned prior to beginning the job at hand. Reference ANSIZ133.1-2000 9.5.1333.1-2000

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazard trees being bucked. On or about 5-13-03, employees bucking a 20' section of a tree did not inform other employees working on the job of their actions. When an employee started to cut the tree and the hazard tree flipped employees were struck by branches on the tree. Among other methods, one feasible and acceptable method to correct this hazard is to remove the branches from one side of the tree, cable or rope the tree and flip it over, then remove the branches from the other side of the tree. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazard trees being bucked. On or about 5-13-03, employees did not participate in a job briefing to ensure that all employees were knowledgeable of the tasks that were being performed at the job site. Employees were not aware that the hazard tree was being cut the day of the accident. Among other methods, one feasible and acceptable method to correct this hazard is to have a job briefing to agree on the sequence of employees actions when working with and around a hazard tree. On or about 5-13-03, employees did not have specific training in the area of individual expertise and work required of a qualified arborist. Training was not provided by the employer and the training was not documented by the employer for duration of employment. Among other methods, one feasible and acceptable method to correct this hazard is to have a employee training program to train employees in the hazards of being an arborist.
