Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to injuries in the event of a tip over accident while operating a powered industrial truck on or about 09/24/03. On or about 09/24/03 at 400 East Main St., Lavonia, GA: Employee was exposed to the hazard of crushing injuries. Employee was operating a forklift without the use of the provided seat belt. "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS": 1) Instruct each employee during initial training and safety meetings, to use the operator restraint system (seat belts) in accordance with The National Safety Council lift truck course. 2) Conduct periodic monitoring inspections of forklift drivers and correct deficiencies immediately.
