Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were not provided the forklift operator restraint system (seat belts),
exposing employees to
crushing injuries in the event that the forklift tipped over.
a)Forklift operators in the Hoover Precision Products, Inc. plant were
operating forklifts
that had not been equipped with seat belts on or about September 24, 2003.
A feasible and acceptable method of abatement to correct this hazard is to
install seat belts in
forklifts from which seat belts were removed and ensure that employees
wear them as required
by ANSI B56.1 consensus standard for powered industrial trucks, and ASME
B56.1-2000-Safety
Standard for Low Lift and High Lift Trucks.d
