Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were not provided the forklift operator restraint system (seat belts), exposing employees to crushing injuries in the event that the forklift tipped over. a)Warehouse area-Forklift operators were operating a Baker forklift that had not been equipped with a seat belts on or about or about October 16, 2003. A feasible and acceptable method of abatement to correct this hazard is to install a seat belt in the forklift and ensure that employees were them as required by ANSI B56.1 consensus standard for powered industrial trucks, and ASME B56.1-2000-Safety Standard for Low Lift and High Lift Trucks.d
