Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of falls.
(a) Employees were not protected from the hazard of falls from a wooden
shop made personnel
cage used to lift them approximately 30 feet above the floor to change
light bulbs. The cage
consisted of several pallets loosely banded together with 2x4s as uprights
and rails. One floor
member of the pallet was noticeably split and two of the corner upright
nail joints were visibly
separating. In some cases the cage was not tied to the forklift. On or
about February 5, 2004.
