Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees who work in the kitchen were exposed to hazards associated with being locked inside the walk-in freezer. a)On or about January 30, 2003, the employer used a padlock to secure the walk-in freezer from unauthorized entry. An employee may become locked inside the walk-in freezer and be unable to exit the freezer. Abatement Note: Among other methods, two feasible and acceptable abatement methods to correct this hazard are: a)Replace the door hardware with a latch that can be opened from the inside even when the freezer is locked.. b) Place an alarm system pull box inside the freezer to alert staff if someone becomes trapped in the freezer.. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
