Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees, in that
employees were exposed to hazards when riding the platform of the  Genie
Powered
Superlift, when the manufacturer did not design the lift for lifting
personnel:
1) On September 17, 2003, and at prior times, employees rode up on a
platform on the
Genie lift to access the upper storage racks.  A warning label on the
Genie Lift stated "no
riders, material lifting only".  The owner's manual stated "The Powered
Superlift is a
material lift only and is not to be used for lifting personnel.
Among other methods, the following are feasible and acceptable methods to
correct this
hazardous condition:
1) Implement a storage system whereby pallets are placed under material to
be stored on the
racks.  The Genie lift could then be used to raise and lower the material
on the pallet, thus
eliminating the need for employees to ride up with the lift.
2) Purchase a material lift meeting the weight limit of the mezzanine area
and that is
designed for employees to safely ride on the lifting platform.
