Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, the use of seat belts by employees operating forklifts was not enforced, exposing employees to crushing injuries in the event of a forklift tip-over or other accident: a) On or about December 16, 2003 and times prior, employees operating forklifts in the warehouse area were not wearing seat belts, exposing them to serious injuries, in the event of a tip-over or other accident. Abatement Verification: Abatement certification is not required for this item.
