Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards when operating fork trucks: a)On or about January 27, 2004, and at times prior, employees were exposed to injury when operating fork trucks while not wearing seat belts. Among other methods, one feasible and acceptable method to correct this hazardous condition would be to train and/or retrain operators on the hazards associated with not wearing a seat belt as well as the requirements to do so. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").
