Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The
employer did not
furnish employment and a place of employment which was free from
recognized hazards
which were likely to cause death or serious physical harm to employees in
that, an employee
was exposed to a fall hazard in excess of 12 feet while performing roofing
activities:
a) On October 18, 2004, and times prior, David Balabanoff dba BM Building
and
Development, was exposed to injury, in that, the employee was using an
un-approved wire
rope lanyard system while performing roofing activities in excess of 12
feet. Mr. Balabanoff
was using 3/8" plastic coated wire rope and a 3/8" wire rope thimble as an
integral part of a
personal fall arrest system:
The manufacturer of the 3/8" wire rope clip, Cooper Industries, Campbell
brand, states the
following in their product information sheet, under an offset type block
with a WARNING
heading: " Do not use on plastic coated wire rope".
The manufacturer of the 3/8" wire rope thimble, Cooper Industries,
Campbell brand, states
in their product information sheet, under an offset type block with a
WARNING heading:
"Do not use for overhead lifting, to support human weight, for playground
or athletic
equipment, or as a safety device".
Among other methods, one feasible and acceptable abatement method to
correct this
hazardous condition would be to have any employer fabricated personal fall
arrest lanyard
system meet the criteria in the non-mandatory 1926 Subpart M, Appendix C,
designed by an
engineer, or approved by a 3rd party fall protection manufacturer prior to
placing such
equipment in use for fall protection.
