North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)employer did not ensure that employees were wearing the seat belts, that were equipped on the fork lift truck by the manufacturer, while operating the fork lift trucks exposing employees to an entrapment hazard in the event of a tip over during fork lift operations. Among other methods, one feasible and accepted method of abatement to correct this hazard is to ensure that employees wear seat belts while operating fork lift trucks.ng
