North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)employees would routinely measure the quantity of material located in tank trailers and tank trucks by standing on top of the tanks and inserting a measuring rod into the tank, without being provided any fall protection, exposing employees to a fall hazard of 10 feet to the paved road below. Among other methods, one feasible and acceptable method to correct the hazard is to provide a positioning device system for employee use while on top of the tank trucks and /or trailers and to ensure that employees have received adequate training to perform the job safely.
