Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The homemade "clamps" and/or "C" hooks used to lift/raise sheets of steel with the overhead crane exposed employees to the hazards of being struck by and/or caught in between loads, in that the throat of the clamp showed wear, the middle section(s) were bowed, and had not been "proof" tested and was not designed for the purpose. A feasible and acceptable method of abating these conditions would be to ensure that all inhouse made lifting devices be inspected, load tested, marked with the capacity and certified in accordance with ASME B30.20-1993 for Below the Hook Lifting Devices.
