Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) Walgreens, Orlando, FL - an employee was exposed to a fall hazard of 5 feet 4 inches. The employee was standing on the forks of a Lull forklift while filling cells with concrete. One means of feasible abatement, among others, American National Standards Institute (ANSI) Standard B56-6-1993, Safety Standard for Rough Terrain Forklift Trucks, Section 5.15.1, would be to provide a personnel platform which complies with the design requirements listed in part III (Section 8.25, Platform for Elevating Personnel) of this standard.
