Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall hazard:
On or about February 28, 2003, and times prior thereto, at, but not
limited to the
Optimius Club Baseball Field, employees who operated a Wilkie Model 540
Ladder, S/N 7954211, were exposed to a fall hazard when the employer
assigned
his employees to use the ladder with a defective wire rope.
One feasible and acceptable abatement including, but not limited to, the
following, is to remove equipment from service and perform preventative
maintenance according to manufacturer's
