Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to being crushed, incurring multiple internal injuries, and/or death in the event of a tip over: (a) WAREHOUSE AREA(S) -- A LINDE BAKER ELECTRIC FORKLIFT TRUCK, MODEL E15S, SERIAL #324JO1306816, HAD A RECENTLY INSTALLED OPERATOR'S SEAT, WHICH DID NOT HAVE AN OPERATOR RESTRAINT SYSTEM FOR EMPLOYEE PROTECTION AS OBSERVED ON OR ABOUT 10/1/2003. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD, IS TO INSTALL A MANUFACTURER'S OPERATOR RESTRAINT SYSTEM OR SEAT BELT RETROFIT.
