Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards created by powered industrial trucks that were not properly maintained and inspected. There was no scheduled planned maintenance, lubrication, and inspection system in place to ensure that maintenance on powered industrial trucks was not neglected, thus creating unsafe conditions for the operators and those working around the trucks. One feasible and acceptable method to correct this hazard is to develop a formal preventative maintenance program that address's the recommendations of the manufacturer's of each of the powered industrial trucks in use. A) LOCATION: ESTABLISHMENT, GRAFTON ST, GRAFTON MA A POWERED INDUSTRIAL TRUCK PREVENTATIVE MAINTENANCE AND INSPECTION PROGRAM WAS NOT DEVELOPED AND MAINTAINED TO ENSURE THAT ALL TRUCKS WERE IN PROPER WORKING CONDITION PRIOR TO THE START OF EACH SHIFT. THE PROGRAM SHALL CONSIST OF A SCHEDULED PLANNED MAINTENANCE, LUBRICATION, AND INSPECTION SYSTEM, DEVELOPED FROM THE MANUFACTURER'S RECOMMENDATIONS, AND REQUIRE THAT ONLY TRAINED AND AUTHORIZED PERSONNEL BE PERMITTED TO MAINTAIN, REPAIR, ADJUST, AND INSPECT INDUSTRIAL TRUCKS.
