Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to the hazard of being struck or
crushed by automobiles being lifted on automotive lifts that were missing
safety devices.  One feasible and
acceptable abatement method to correct this hazard is to ensure that there
are functional positive stops on the
lifts to ensure that the raised automobiles can not be inadvertently
lowered by employee error or by
mechanical failure and to prevent the raised automobiles from being turned
around  while in the raised
position.
A) LOCATION: AUTOMOTIVE REPAIR SHOP
TWELVE AIR/OIL SYSTEM HYDRAULIC LIFTS WITHIN THE FACILITY WERE NOT SUPPLIED
WITH FUNCTIONAL GUIDE POSTS AND SAFETY LATCHES TO ENSURE THAT THERE WAS A
POSITIVE MEANS IN PLACE TO PREVENT AUTOMOBILES FROM COMING DOWN FROM THEIR
RAISED POSITIONS INADVERTENTLY, STRIKING WORKERS WORKING AROUND AND UNDER
THE VEHICLES.  THE LIFTS WERE INSTALLED WITH GUIDE POSTS DESIGNED TO RAISE
FROM
THE GROUND AS THE LIFT GOES UP AND ALLOW SAFETY LATCHES TO  CLICK INTO
PLACE,
SECURING  THE VEHICLE WHEN IN THE RAISED POSITION. IN ADDITION TO SECURING
THE
VEHICLE IN THE EVENT OF A HYDRAULIC OR AIR FAILURE, THESE POSTS ALSO
PREVENT
THE SINGLE CYLINDER LIFTS FROM SPINNING. THE SAFETY MECHANISM ON EACH OF
THE
LIFTS WERE EITHER BROKEN AND OR NOT ATTACHED TO THE LIFTS.
