Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees: An employee was exposed to fall hazards from a work platform attached to the lifting carriage of a forklift which did not have adequate guardrail protection for the ends of the platform, and the employee was also not wearing an approved type safety harness. Abatement Guidelines: As of 1/1/98, 1926.502(d) provides that body belts are NOT acceptable as part of a person fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).
