Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees: Two employees were observed working approximately 35 feet above grade from a rough terrain forklift basket without the use of a PFAS. Additionally, the basket extended past the wheel base approximately 2 feet on each side, the basket was not secured to the mast, and employees were increasing their working height by leaning a 2x6 against the guardrail and standing on it without the use of fall protection.
