Minn. Stat. 182.653 subd. 2:  The employer did not furnish to each
employee, conditions of
employment and a place of employment free from recognized hazards which
caused or were
likely to cause death or serious injury to employees:
Employees were exposed to fall hazards in excess of 15 feet while working
from a
personnel basket, which was attached to the forks of rough terrain
forklift.  The basket
was not equipped with an adequate guard rail system.  Employees were not
wearing any
personal fall arrest equipment while installing vertical panels on the
south end of the
south "free-stall" barn.  The ground to roof peak height was approximately
25 feet.
Employees rode in an elevated basket when work progressed to the east side
of the
building.  Employees needed additional training in fall protection hazard
recognition.

Employees were exposed to potential crushing hazard injuries when a New
Holland LM
840 forklift was used to elevate employees in a personnel platform when:
1)No information tag on the personnel basket, certified by an engineer,
regarding
maximum load, empty platform weight, or minimum capacity of the forklift
used
to lift platform.
2)The width of the platform exceeded recommended manufacture guidelines for
forklift.
