Minn. Stat. 182.653 subd. 2:  The employer did not furnish to each
employee, conditions of
employment and a place of employment free from recognized hazards which
caused or were
likely to cause death or serious injury to employees:
The rail car unloading area for the east and west ends lacked fall
protection in the form
of a body harness with lanyard attached to a substantial member of
structure with a
minimum rating of 5000 pounds per employee that is exposed.  Other
suitable means of
fall protection may be used to prevent employee(s) from falling off the
tops of rail cars
while performing assigned duties.
