Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY LOAD: a)Dump Body Division, on or about 7/24/03: The following hoists were not being inspected on a frequent and periodic basis: 1)Near Post Q14, 1-Ton CM Hoist had not been inspected and the hook safety latch was missing. 2)4-Ton Coffing Hoist had not been inspected and the pendant controls were not labeled. 3)Near Post N16, 2-Ton Coffing Hoist had not been inspected. 4)Near Post L16, 2-Ton Coffing Hoist had not been inspected. Among other methods, one feasible method of abatement is to conduct frequent and periodic inspections of the hoists to identify wear, deterioration, malfunction and to make the necessary repairs, as per ASME B30.16-1993. b)Dump Body Division, on or about 7/24/03: The support structures for the following hoists had unknown load capacity ratings: 1)Near Post Q14, 1-Ton CM Hoist support structure was not provided with a load capacity rating. 2)4-Ton Coffing Hoist support structure was not provided with a load capacity rating. 3)Near Post N16, 2-Ton Coffing Hoist support structure was not provided with a load capacity rating. 4)Near Post L16, 2-Ton Coffing Hoist support structure was not provided with a load capacity rating. Among other methods, one feasible method of abatement is to inspect the support structures for the hoists as per ASME B30.16-1993, to ensure the structure is designed to withstand the loads and forces imposed by the hoist for the rated load and to label the structure accordingly. c)Dump Body Division, on or about 7/24/03: Below the hook lifting device used to lift 1200 pound boxes had an unknown load capacity rating and was not being inspected on a frequent and periodic basis. Among other methods, one feasible method of abatement is to conduct frequent and periodic inspections of the lifting device and mark the lifting device with the rated load capacity as per ASME B30.20-1993.
