Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY MOBILE EQUIPMENT: a)Facility Wide, on or about 7/28/03: A Euclid model R-22, end dump serial number 49737 used by an employee to haul waste/broken stone to dump area had an inoperative horn. ABATEMENT NOTE: One means of abatement is to repair the horn. b)Facility Wide, on or about 7/28/03: A Euclid model R-22, end dump serial number 49737 used by an employee to haul waste/broken stone to dump area and had an obstructed view to the rear was not provided with a reverse signal alarm. ABATEMENT NOTE: One means of abatement is to install a reverse signal alarm. c)Facility Wide, on or about 7/28/03: A Euclid model R-22, end dump serial number 49737 used by an employee to haul waste/broken stone to dump area had an inoperative emergency brake. ABATEMENT NOTE: One means of abatement is to repair the emergency brake.
