Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY MOBILE EQUIPMENT: a)Kenney Middle School jobsite, on or about 10/27/03: Sky Trak model 5028 rough terrain forklift truck, serial number 11536, used by employees to transport mixed mortar cement from mixer area to area's where mason tenders can disperse it had an inoperative horn. ABATEMENT NOTE: One means of abatement is to ensure that all warning devices are in place and in working order per American Society of Mechanical Engineers, ASME B56.6-1992, Part II, Section 5.13.1, Safety Standard for Rough Terrain Forklift Trucks.
