Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to THE HAZARD OF BEING STRUCK-BY THE LOAD:
a) On or about 3/12/04 in the Warehouse Bldg. 1:  Employees operating a CM
Lodestar Hoist, an under the hook lifting device and platform to transport
dry goods to and from the first floor of the warehouse were not protected
from struck by hazards in that the under the hook lifting device frame bar
and tower rails were not load rated for maximum weight that could be
transported and the platform and frame were not inspected as required.
ABATEMENT NOTES:
Among other methods, one feasible and acceptable method to correct the
hazard is
to:
1.  Have a qualified person review the design of the supporting structure
and
establish rated load capacity as per American National Standards
Institute/American
Society of Mechanical Engineers, ASME B30.20- 1993 Chapter 20-1, Section
20-1.2
and inspect the platform and frame monthly in accordance with ASME B30.20.
b)On or about 3/12/04 in the Warehouse Bldg. 1:  Employees working on the
first floor were exposed to being struck by the hoist platform.
ABATEMENT NOTES:
Among other methods, one feasible and acceptable method to correct the
hazard is
to:
1.  Barricade the platform loading area to prevent employees from entering
the
loading zone of the platform per ANSI A10.5-1975 section 18.
c)On or about 3/12/04 in the Warehouse Bldg. 1:  Employees operated a
Toyota fork lift truck,model number 4FL15, serial number FGL18-3120,
without a seat belt.  Employees exposed to the hazard of being struck by or
thrown from the fork lift truck in an accident.
ABATEMENT NOTES:
Among other methods, one feasible and acceptable method to correct the
hazard is
to:
1.  Install seat belts on the Toyota fork lift truck.
2.  Follow the requirements of the American National Standards Institute
for Safety
Standard for Low Lift and High Lift Trucks(ASME B56.1-1993, Chapter
5.3.19).
Abatement certification must be submitted for this item.
