Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to extremely low temperatures which could result in hypothermia.
The frozen food
walk-in freezer did not have any type of mechanism to open the door from
the inside of the
freezer if was closed.

On or about March 18, 2003
Employees were exposed to the extreme low temperatures which could result
in
hypothermia.  The walk-in freezer door for the produce department could
not be
opened from the inside of the freezer.  The hardware was missing from the
door
which would allow the door to be opened from the inside.
Among other methods, feasible and acceptable methods to correct this
hazard is to:
a) Install a door handle mechanism that complies with Underwriter's
Laboratories Standard UL
471 and/or the National Sanitation Foundation Standard 7 (NSF/ANSI 7-2001,
ANSI/ASHRAE
117-1992) .  The handle would enable the employee to open the door from
the inside.
Note:  The employer is required to submit abatement certification for this
item in accordance
with 29  CFR 1903.19.
