Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to:
(a)TARCO, Inc. & Windsor Lake, Windsor, CO:  On or before April 14,
2003, the exposing employer did not ensure that earth-moving equipment,
operated by employees after dark, had functional brake lights and/or tail
lights.
Employees were exposed to struck by hazards, particularly from earth-moving
equipment operating from behind.  Vision was obscured by dust and darkness,
in areas without light plants available, making it difficult to determine
if the
leading vehicle was slowing down or stopping.
Among other methods, one feasible and acceptable abatement method to
correct is:
(a)Install/replace brake lights on earth-moving equipment in accordance
with SAE
(Society of Automotive Engineers) J1029, revised September 1996, "(R)
Lighting and Marking of Construction, Earthmoving Machinery".
