Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to a "struck by" hazard:
(a) Con-Way Western Express, 9801 Dallas St., Henderson, CO 80640: On
or before 4-16-03, the employer did not ensure that employees operating
forklifts utilized personal restraint devices (seatbelts) during vehicle
operation.
Condition exposed employees to the hazard of being ejected from the
vehicle.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to:
(a) Implement a seatbelt training and enforcement program in accordance
with
ASME/ANSI B56.1-1993 Safety Standard for Low Lift and High Lift Trucks.
