Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of falling from the elevated
personnel platform
mounted on the rough terrain forklift truck:
a)Colorado Quality Steel Erectors at 74th Ave. and Highway 85,
Commerce City, CO:  On or before July 8, 2003, the employer did
not ensure that the platform for elevating personnel mounted to the
rough terrain forklift truck was rated for not less than 2 to 1 structural
safety factor based on the minimum yield strength of the materials used
on this platform.  The platform did not have a known rated capacity
and had a drift pin which had the retaining pin fractured from the pin.
Among other methods, one feasible and acceptable method to correct the
hazard is to
conform with the requirements of American Society of Mechanical Engineers
ASME B56.6-
1992, Section 8, Sub-Section 8.25.1, Paragraph o.
