Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard which could inflict death or serious injury while transferring granite slabs from the storage yard to the fabrication shop: (a) Advantage Stone Fabrication, 31 Prince Street, Longmont, CO 80502: The granite and marble slabs were stored in a yard adjacent to the fabrication shop. They were stored on metal rack at an angle of 80 degrees. The slabs were not secured with any type of device that could be used to control the movement of the slabs while they were being attached to the extension of the forklift. When retrieving a slab, employees were required to separate the slab from the others on the rack in order to attach the clamp on the forklift extension to the slab. This placed the employee between the granite slab and the forklift. This posed a "struck-by hazard" to the employees performing this work.
