Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to a struck by/crushing hazard:
(a) Hamlin Electric Co. at the Vail Feeders 2003 Project, Vail, CO: On or
before
October 1, 2003, the employer did not ensure that employees stayed outside
of the
swing radius of the #315 CL Caterpillar Excavator, thereby exposing one or
more
employees to a struck by/crushing hazard. Among other methods, one
feasible and
acceptable method to correct this hazard is to instruct workers to:  Stay
outside of the
swing radius of the bucket and to exit the trench in the direction distant
from the
excavator rather than walking toward the excavator to exit the trench.
