Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard which could inflict death or serious injury while transferring granite slabs from the storage yard to the fabrication shop: (a) Avanti Marble and Granite, 1450 Grove Street, Denver, CO 80204: The granite and marble slabs were stored in a yard adjacent to the fabrication shop. They were stored on metal rack at an angle of 80 degrees. The slabs were either not secured or the ropes that were used to control the movement of the slabs while they were being attached to the extension of the forklift were worn. When retrieving a slab, employees were required to separate the slab from the others on the rack in order to attach the clamp on the forklift extension to the slab. This placed the employee between the granite slab and the forklift. This posed a "struck-by hazard" to the employees performing this work. (b) The large granite slabs weighing up to 600 pounds were about 5 feet wide and 8 feet long. They are brought to the fabrication shop using an industrial forklift truck. The slab was placed on the floor adjacent to the diamond saw table by three to four employees. Once released from the forklift truck, the employees lean the slab back toward the cutting table. The work practice of man-handling such a large stone slab places the workers in such a position where they could be struck by the stone slab if the employees were to lose control of it. There are devices such as cranes and tilting tables that can be used to place the stone slabs on the diamond saw table.
